Definition

The following ‘terms’ shall apply. Turkey Motorbike Tours Ltd ‘us’ or ‘we’ refers to the owner of the website. The terms ‘you’ or ‘Participant’ refers to the user or viewer of our website. The term ‘tour’ is the tour you have chosen from the website.

Bookings and Financial Terms Deposit

A deposit of £200 per person is required to book a place on any of our tours. All deposit payments can be paid by paypal or direct bank transfer. Upon receipt of the deposit and completed booking form it is agreed that you are accepting Turkey Motorbike Tours Ltd terms and conditions and we will reserve a place on your chosen tour.

Payment of balance

Upon receipt of a completed booking form and deposit you will be issued with a confirmation notice and invoice via email which contains details of your tour reservation, terms and conditions and the tour ‘balance payment’ date. On our tours the full balance payment is due no later than 60 days before date of travel or your reservation will be cancelled. Balance payment can be made by direct bank transfer. Payment may also be made by debit/credit card but a 3.5% surcharge will apply. Bookings made 60 days or less before the departure date will be accepted only with full payment or by prior agreement. Only those who have paid in full will be allowed to participate in the tour.

• Protection of your money

  In accordance with the Package Travel, Package Holiday and Package Tour Regulations 1992 and EC Directive 90/314EC, all monies are held by Turkey Motorbike Tours Ltd in a trust account until such a time as your tour is complete.

• Insurance

  On all our tours it is a condition of booking that you must hold valid and adequate travel insurance repatriation of you, your pillion (if applicable) to cover treatment and repatriation in the event of accident/illness. Each eligible Participant should also carry a ‘European Health Insurance Card’ (EHIC).

Our Responsibilities

Turkey Motorbike Tours Ltd is responsible for ensuring that any part of the tour programme booked, where it is within their control, is supplied as described in the Website. However, please be aware that during the tour some amenities (i.e. hotel lifts, swimming pools etc) require regular servicing and cleaning and therefore may be inaccessible at times. We cannot be held responsible for some amenities being affected by local conditions, maintenance, weather conditions or mechanical breakdowns. Turkey Motorbike Tours Ltd makes reasonable efforts to ensure that the correct arrangements have been made for all the tours on the website and that the suppliers of services are efficient and reputable. Turkey Motorbike Tours Ltd cannot be held responsible for death, personal injury or illness caused by activities engaged in which are outside the tour itinerary. We also cannot be held responsible for death, personal injury or illness howsoever caused unless we are shown to be negligent. Also, we are not responsible for any loss or damage to your property including your hired motorcycle irrespective of how any damage may have been caused.

Your responsibilities

Participation in any tours is entirely at your own risk. You are responsible for your hired motorcycle. You are also responsible at all times for any pillion travelling with you. Any accident, bodily injury, illness or death to rider or pillion during your tour is not the responsibility of Turkey Motorbike Tours Ltd.
We expect a level of competency and an ability to fully control your motorcycle at all times. You are expected to ride in a courteous and safe manner in respect to your fellow riders and other road users.
When booking a tour we assume that the participant (and pillion if applicable) will have read the Tour Itinerary and will be fully aware of the route, destinations and the approximate mileages for each day and will have made the judgement that it is an appropriate tour for them to undertake.

• You must be a competent rider with the hire bikes
• You must hold a valid Motorcycle riding licence
• You must hold a valid passport and visa if required
• You must advise Turkey Motorbike Tours Ltd of any illness,
• medical conditions, allergies or dietary needs that may affect your tour
• You must hold a European Health Insurance Card (EHIC)
• (can be obtained online at www.dh.gov.uk/travellers or by post from any main Post Office)
• You must hold valid personal travel Insurance for you and your pillion (if appropriate).
• This must include medical cover including any possible repatriation in the event
  of serious illness or accident.

If Turkey Motorbike Tours Ltd changes you’re booking

Arrangements for your tour are made some months in advance it is therefore possible that minor changes to an itinerary might be necessary. In most cases, these changes will be minor and will not effect your holiday. However, if significant changes are made after you had booked, (i.e. point of departure, date of departure, final destination or any event which may reduce the quality of the tour) you are free to continue with the tour with the revised itinerary or accept the offer of an alternative tour of the same value. Alternatively, the booking may be cancelled in return for a full refund.
Once the tour has commenced Turkey Motorbike Tours Ltd Ltd reserves the right to alter routes and accommodation at short notice due to circumstances beyond our control. In this situation Turkey Motorbike Tours Ltd will notify you as soon as reasonably possible.

If Turkey Motorbike Tours Ltd cancels you’re booking

Turkey Motorbike Tours Ltd reserves the right, in any circumstances, to cancel your booking and will notify you as soon as reasonably possible. However, this would only become necessary in exceptional circumstances. In such an event we would:
a) Offer you an alternative tour of equal or greater value or: b) offer you a full refund. Turkey Motorbike Tours Ltd will not be held responsible or offer a refund or compensation in any of the following situations: terrorist activity, war, threat of war, civil strife, riots, natural or nuclear disasters, industrial disputes, unavoidable technical problems with transport or acts of god.

If you cancel your tour booking

If you cancel your booking following confirmation Turkey Motorbike Tours Ltd reserves the right to withhold the deposit/tour payment in part or full for costs incurred on the following scale:
More than 90 days: Full refund minus a £60 admin fee
89 to 60 days: Loss of deposit
59 to 31 days: 50% of tour
30 days or less: No refund
All Cancellations must be received in writing and sent to:

Once the tour has commenced if for any reason a participant decides to leave the tour before the end he/she will not be refunded. Turkey Motorbike Tours Ltd will not be responsible for any associated cost incurred.

Delays in your journey

Turkey Motorbike Tours Ltd cannot be held responsible for unforeseen delays caused by: terrorist activity, war, threat of war, civil strife, riots, natural or nuclear disasters, industrial disputes, unavoidable technical problems with transport, failure of hoteliers, blockades, acts of god, flight, ferry operators or other suppliers. Turkey Motorbike Tours Ltd cannot be held responsible for any compensation or delays to a journey including International or internal flights, ferry crossings to/from Turkey or other ports). In the event of any delay you will be responsible for providing all your own additional meals, travel and accommodation.

Transfer of booking

In the event of you having to cancel the tour for any reason you may transfer the booking to another person providing a minimum of 2 weeks notice is given. However, you will be liable for any administration costs we may incur and are responsible for your nominee paying their monies in full and on time.

Surcharges

The tour price will not be subject to a surcharge save that in exception circumstances resulting from Government action affecting transportation cost and/or currency fluctuations. There may be instances where circumstances beyond our control dictate an increase in the cost. We will not pass on any increase less than 4%. Turkey Motorbike Tours Ltd reserves the right to introduce a proportionate surcharge for increases larger than this if they occur more than 60 days before travel. If as a result of the surcharge the increase is more than 10% of the stated tour price you will be given the option to cancel your booking and receive a full refund.

Complaints procedure

n the event of you wishing to make a complaint, you should in the first instance approach your tour representative. If you still consider that your complaint has not been properly addressed, you should put your comments in writing and send to: Turkey Motorbike Tours Ltd, 49 Kingsmead Cheshunt EN80EH England.
